Property and registration law has undergone far reaching changes. The changes place obligations on legal professionals and landowners alike. Not everyone is aware of the changes. Could you be losing out as a result of the changes to the property system in Scotland?
The Land Registration etc. (Scotland) Act 2012 came into force on the 8th of December 2014. The rationale behind this Act was to build on the foundations set down by the Land Registration etc. (Scotland) 1979 Act and to strive to have all land in Scotland registered, rather than recorded.
This resulted in the Scottish Government setting an ambitious target of having all land in Scotland registered in the Land Register of Scotland by 2024 (2019 for all public land, i.e. that owned by local authorities, for example). The end point of the 2012 Act is that all land will be registered on the map based Land Register resulting in the complete closure of the sasine register.
