Fiona McGougan is a Solicitor in our Property Department, she has been with TC Young since 2020 and has 4 years’ conveyancing experience.
Fiona has experience in dealing with all aspects of land acquisitions and the negotiation and preparation of development agreements, regularly undertaking Design and Build, Golden Brick and Turnkey site acquisition transactions from the outset to conclusion. She regularly prepares Deeds of Conditions to assist clients to manage maintain and preserve the amenity for client developments. In her dealings with development Fiona negotiates and helps clients administer planning conditions including Section 75 Agreements. She has experience in negotiating and drafting Deeds of Servitude and Wayleaves with utility providers and other third parties on behalf of clients.
Fiona regularly undertakes examination of title deeds for clients to provide advice on any necessary corrective conveyancing, and the discharge of burden obligations including drafting and submitting applications to Lands Tribunal for Scotland. In addition she provides advice on the interpretation of title deeds, the Title Conditions (Scotland) Act 2003 and the Tenements (Scotland) Act 2004 with regards to factoring services provided by clients and reviews and updates Written Statements of Service in line with the Property Factors (Scotland) Act 2011 and factoring Code of Conduct.
In addition, Fiona has experience with the preparation and negotiation of commercial leases, including assisting with minutes of extension/variation, assignations, rent reviews and notices to quit.
Fiona assists with training and support for our Registered Social Landlord clients on all matters relating to development proposals and planning conditions and all aspects relating to factoring services.
