FAQs

The answers to some of our most frequently asked questions.

The first step in the debt recovery process is issuing of a 7-day demand for payment.  If not forthcoming, the next step would involve an application for payment in the First-tier Tribunal. An evidential hearing may be required where the debt is in dispute. Where a payment order is granted, the next stage involves enforcement of the order including:

  • Service of a charge for payment
  • Diligence
  • Sequestration (if applicable)

Our specialist team can support you through every stage of the debt recovery process.

Not only does our legal team hold the in-depth knowledge regarding Scotland’s debt recovery procedures as it relates to tenancy law, but it also applies effective debt recovery tools tailor-made for your situation. You can rely on us to provide pragmatic advice, acknowledging the specific circumstances of your case to maximise debt recovery where possible. Where sequestration (bankruptcy) is possible, our team has additional expertise in the sheriff court, where this procedure must be raised.

The time taken for the debt recovery process can vary owing to the complexity of the debt and how a debtor responds to it. Our team will strive to conclude all cases without delay.
